Subtly — Terms of Use

These Terms of Use ("Terms") are the contract between you and getsubtly Ltd ("Subtly", "we", "us") when you use the Subtly mobile app. Please read them before using the app. If you do not agree, please do not install or continue to use it.
1. Who we are
getsubtly Ltd is a company registered in England and Wales (company number 17166772). Our registered office is Flat 21, Jubilee House, 126 Chapeltown Road. You can contact us at hello@getsubtly.com for general enquiries or support@getsubtly.com for help with the app.
2. The service
Subtly is a mobile app that lets you manually log small transactions and see how they accumulate over time. Subtly does not connect to your bank, does not give financial advice, and is not a regulated financial service. It is a personal awareness tool only.
3. Not financial advice
Nothing in Subtly — including any total, projection, tag, insight, or weekly recap — is financial, investment, tax, or legal advice. You are solely responsible for any financial decisions you make. If you need advice, speak to a qualified professional.
4. Your account
You need an account to use Subtly. You agree to (a) provide accurate information, (b) keep your sign-in credentials secure, (c) be responsible for everything that happens under your account, and (d) tell us at support@getsubtly.com if you suspect unauthorised access. Subtly is for your personal, non-commercial use.
5. Free and paid features
Subtly offers a free tier with core manual logging, and a paid "Subtly Premium" tier with additional features (unlimited tags and quick-add tiles, widgets, Live Activities, weekly recap with projections, priority support). The current paid features are listed on the paywall inside the app and may change from time to time. CSV export of your own data is free forever.
6. Subscriptions, billing and trials
Subtly Premium is offered as a monthly subscription at £2.99 per month and an annual subscription at £19.99 per year (or the local equivalent at the time of purchase).
The annual subscription includes a 7-day free trial for new subscribers only. The monthly subscription does not include a free trial.
Payment is taken by Apple (via the App Store) or Google (via Google Play). We do not see or store your payment card details.
Your subscription renews automatically at the end of each period unless you cancel at least 24 hours before the end. You can cancel at any time in your Apple ID or Google Play subscription settings.
If you cancel during the free trial you will not be charged.
Prices may change in future. If we increase the price, Apple or Google will notify you and you will be given the chance to accept or cancel before the new price applies.
7. Refunds
Refund requests are handled by Apple or Google, not by us. Apple: reportaproblem.apple.com. Google Play: play.google.com/store/account/orderhistory. For UK consumers, your statutory rights under the Consumer Rights Act 2015 are not affected by these Terms.
8. Your data and your content
Transactions, tags, and notes that you log are your content. You own it. You give us a limited licence to host and process it solely so we can provide the Subtly service to you. How we handle your personal data is described in the Privacy Policy at getsubtly.com/privacy. You can export your data at any time via CSV, or delete your account (and all associated data) in Settings.
9. Acceptable use
You must not:
Use Subtly in any way that breaks the law or infringes the rights of others.
Attempt to reverse-engineer, decompile, or extract source code from the app, except where this is allowed by UK law and cannot be waived by contract.
Interfere with the operation of the app or the servers that run it, or attempt to access other users' accounts.
Resell, sublicense, or commercially redistribute the app or any part of it.
Use the app on behalf of a business or organisation without our written permission.
10. Intellectual property
Subtly, the Subtly name, the green-monogram logo, all app designs, and all associated materials are owned by getsubtly Ltd or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your personal use, in line with these Terms and the applicable app store terms.
11. Availability and changes to the service
We will make reasonable efforts to keep Subtly available, but we do not guarantee uninterrupted service. We may change, add, or remove features from time to time. Where a change materially reduces functionality available in the paid tier during a paid period, we will either keep the functionality available until the end of that period or offer you a pro-rated refund of the unused portion.
12. Disclaimers
To the fullest extent permitted by law, Subtly is provided on an "as is" and "as available" basis. We do not warrant that the app will be free of errors or uninterrupted, that any specific feature will meet your needs, or that totals or projections shown in the app are accurate. You use the app at your own risk.
13. Liability
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.
Subject to that, our total liability to you for any loss or damage arising out of or in connection with your use of Subtly (whether in contract, tort, under statute, or otherwise) is limited to the greater of (a) the amount you have paid getsubtly Ltd in the 12 months before the event giving rise to the liability, and (b) £50.
We are not liable for any loss of profit, loss of business, loss of goodwill, loss of data (except where caused by our own failure), or any indirect or consequential loss. Subtly is a consumer app — you should not rely on it for mission-critical or commercial purposes.
14. Termination
You can stop using Subtly at any time by deleting your account in Settings. We may suspend or terminate your account if you materially breach these Terms, and we will tell you why where lawful to do so. If we terminate your paid subscription for a breach that you caused, we will not issue a refund.
15. Changes to these Terms
We may update these Terms from time to time. If the change is material we will notify you in the app and by email before it takes effect. Your continued use of Subtly after the change means you accept the updated Terms. If you do not accept, please delete the app and cancel your subscription.
16. Governing law and disputes
These Terms are governed by the laws of England and Wales. You and Subtly agree that the courts of England and Wales have non-exclusive jurisdiction to resolve any dispute, except that if you are a consumer resident in another UK nation, you may also bring proceedings in your local courts.
17. Apple App Store — additional terms
If you downloaded Subtly from the Apple App Store: these Terms are between you and getsubtly Ltd, not Apple. Apple is not responsible for the app or its content. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is a third-party beneficiary of these Terms and may enforce them against you.
